GENERAL TERMS AND CONDITIONS

1. type of contract and type of service

1.1 Type of contract
The booking agreement between the traveller and Dein-Ferienhaus-LaPalma.de is a travel agency contract, services of a third party are arranged or procured.

1.2 Performance and type of performance
The service offered by Dein-Ferienhaus-LaPalma.de is that of presentation and mediation. The offered objects are conscientiously selected by us and catalogued and described according to our own knowledge. Photographs are taken by us on site. The mediation offered by Dein-Ferienhaus-Lapalma is an external service. The respective house owner / landlord of the rental object is responsible for the fulfilment of the contractual service.

2. conclusion of contract

2.1 Booking
With the booking, the customer offers the binding conclusion of the contract. The booking can be made in writing, by email, orally or by telephone. Upon acceptance of the booking by Dein-Ferienhaus-LaPalma.de, the customer will receive the booking confirmation by email. The customer is obliged to check the booking confirmation received immediately for its correctness and to inform the travel agent of any inaccuracies. The notification of discrepancies must be made immediately. Inaccuracies or discrepancies that are reported late do not entitle the customer to withdraw from the contract.

2.2 Assignment
The booking is only valid for the number of persons stated in the booking confirmation. Should the rental property be occupied by additional persons not listed, a corresponding additional payment will be charged. It is to be considered that the respective object cannot be occupied over the maximum permitted number of persons and the facilities may be used only under arrangement with Dein-Ferienhaus-LaPalma.de for festivities.

2.3 Payment
A deposit of 15% up to 50% is due upon receipt of the booking confirmation.
With the payment of the deposit you accept these general terms and conditions and the rental contract / booking confirmation becomes legally binding. 
As a rule, the remaining amount must be paid in advance 4 weeks before the date of arrival. If the period is 4 weeks or less when the contract is concluded, the total amount is due immediately. For some properties, the balance is only due on arrival, please refer to the booking confirmation for the relevant information.

3.1 Method of payment
Please note that Dein-Ferienhaus-LaPalma.de is not responsible for any bank charges that may be incurred. When paying by credit card (Visa, American Express and MasterCard) Dein-Ferienhaus-LaPalma.de charges a fee of 1,5% of the amount to be paid. (Payment by credit card is not yet possible!) If payments are not made according to the deadlines stated in the booking confirmation, Dein-Ferienhaus-LaPalma.de reserves the right to cancel the reservation and to charge a fee according to the cancellation policy.

3.2 Guarantee certificate
Dein-Ferienhaus-LaPalma.de is a Spanish agency. There is no security certificate in Spain.

4 Liability and complaints

4.1 Liability
Dein-Ferienhaus-LaPalma.de is liable as a travel agent within the scope of due diligence for the conscientious selection and description of the rental properties according to its own knowledge and the information provided by the cooperation partner. Should the cooperation partner (owner/manager) fail to inform Dein-Ferienhaus-LaPalma.de of subsequent changes or provide incorrect information, the obligation lies with the cooperation partner. Dein-Ferienhaus-LaPalma.de gives no assurances or guarantees of its own for the correctness and completeness of the information about the travel services.

4.2 Duty to cooperate
The tenant is requested to report defects in the house or furnishings immediately upon discovery or within 24 hours at Dein-Ferienhaus-LaPalma.de, so that these can be immediately repaired. Subsequent complaints can not be considered. The tenant is obliged to treat the house and facilities with care, to report any damage caused by him to the rental property to the owner / manager on site and to bear the cost of repair or replacement.

5 Withdrawal and rebooking

5.1 Withdrawal / cancellation
In the event of withdrawal from the contract, the following cancellation costs apply:
from conclusion of the contract and up to 60 days before the start of the trip: 15% of the trip price excl. final cleaning,
from 59 to 30 days before the start of the trip: 40% of the trip price excl. final cleaning,
from 29 to 8 days before the start of the trip: 60% of the trip price excl. final cleaning,
from 7 days to 1 day before the start of the trip: 80% of the trip price excl. final cleaning.
from 7 days to 1 day before the start of the trip: 80% of the trip price excl. final cleaning
and in the event of no-show on the day of arrival: 100% of the trip price excl. final cleaning.
The cancellation must be made in writing, the date of receipt is decisive. The customer has the option of proving that less or no damage has been incurred. An additional processing fee of 50,- Euro will be charged for each cancellation. We recommend taking out travel cancellation insurance. Rental contracts at last-minute conditions or special prices cannot be cancelled.

5.2 Rebookings
The tenant can withdraw from the booking before the start of the trip if he provides a replacement party who takes over the contract under the same conditions. The rental object can be changed only by travel resignation to the conditions described above and a new registration. Duration of the trip and dates can be changed depending on availability, taking into account the cancellation conditions. Rental contracts at last minute conditions or special prices cannot be rebooked. For each rebooking or contract change an additional processing fee of 50,- Euro will be charged.

6. data protection
Personal data provided for the purpose of processing the travel contract is protected against misuse in accordance with the provisions of data protection law. You can find more details on this in our data protection declaration.

7. place of fulfilment and jurisdiction
Claims for damages are to be addressed directly to the respective contractual partner (property owner, landlord). The place of fulfilment and jurisdiction is Spain in accordance with EU regulations.
